This is a legal contract between the customer or user of any services provided by The Vintage Playhouse, LLC. The customer, hereinafter referred to as "customer", "you", and "your", and The Vintage Playhouse, LLC, hereinafter referred to as The Vintage Playhouse, LLC, The Vintage Playhouse, The Vintage Playhouse.com, "we," "our," or "us", includes all authorized dealers, agents, employees, owners and affiliates of The Vintage Playhouse, LLC. The site refers to www.thevintageplayhouse.com.

The customer accepts this store's policies by making a purchase, placing an order, or otherwise shopping, browsing, or viewing of material on this site or any affiliated sites. The terms and conditions of this agreement are subject to change at anytime without prior notice. The Vintage Playhouse Store Policy constitutes the entire agreement between the customer and The Vintage Playhouse relating to the purchase or sale of goods and use of the site. The Store Policy may only be modified or terminated in writing signed by The Vintage Playhouse.

In the event of any conflict between the terms and conditions stated on your purchase order and this agreement or any terms and conditions on our invoice, you agree that the provisions of our Store Policies, our agents and invoice shall control.

Please fill in all of your Order Information correctly and completely. The Vintage Playhouse and its agents are not responsible for typographical errors or outright mistakes in your provided information. Orders will NOT be reshipped because of wrongfully supplied, incorrect, or incomplete information. We verify all billing information provided by the customer. Please enter all information corrrectly; otherwise, your order can be delayed from 48 to 72 working hours for further verification.

As forms of payment we accept Visa, Mastercard, American Express, Discover, Certified Check or Money Orders and personal checks. Personal checks are subject to a $25 surcharge for insufficient funds. Visa, Mastercard, Discover and American Express can be used for online order payments and may not be used for the Off-Line ordering process. We do not accept wire transfer or any other form of payment except those specifically listed. Personal checks may be held for up to 14 business days for verification and fund availability and verification.

 

It is understood by the customer that some of the DVDs sold by The Vintage Playhouse have been individually compiled from original film stock and public domain wholesaler sources. These sources have an inconsistent level of preservation associated with them. In accordance the playback experienced may vary from movie to movie on any DVD collection purchased. Every effort has been given to maintain true DVD quality, but the customer understands and accepts that some level of imperfection is present in each film and that level of imperfection can vary significantly between films. This means the customer accepts that their may be "pauses" or "skips" present in the playback of any given film. We have made every effort to keep errors to a minimum, but they may still exist. The customer accepts this as part of their set, and as part of owning films directly converted from original film stock.

 

The customer is eligible for a full refund within 14 days of Delivery (including weekends and holidays). The customer must contact us within 14 days of delivery to arrange and Return Merchandise Authorization (RMA). The Vintage Playhouse LLC does not offer "price adjustments" or credits on items that are presently on-sale, but were purchased at a higher price. We will replace any defective discs you have, within 90 days of delivery. There are absolutely no refunds or exchanges after 14 days. No exceptions. All product elligible for return or 90-day exchange warranty must be in their original factory condition. Products should be free of food stains, markings, and any signs of physical damage or stress.

All returns and exchanges must have a proper Return Merchandise Authorization Number (RMA#) assigned and attached to the returned product/package. We will not return or exchange a product without the proper RMA#. The Vintage Playhouse LLC will not be held responsible for returns and exchanges sent without prior authorization by The Vintage Playhouse LLC. The customer will be responsible for return shipping should the product's warranty be void or return period expired. All items should be shipped with insurance and tracking information. The Vintage Playhouse LLC is not responsible for lost items shipped back to our facilities. Please insure your returns/exchanges.

 

Shipments

Your items are shipped based on the availibility displayed on each product product page. Delivery times to not include these processing times. Order typically take about 24 to 72 hours to process. Personal checks require 5-14 days for funds to clear. The Vintage Playhouse shall not be held responsible for packages once tracking status of the package is delivered. International Shipping Terms are FOB: Our Facilities. The customer is responsible for any customs fees or tariffs associated with their respective country. Please check with your local authorities before placing an order as to the particular laws of your country.

Typographical Errors
In the event that a The Vintage Playhouse LLC product is mistakenly listed at an incorrect price, The Vintage Playhouse LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. The Vintage Playhouse LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, The Vintage Playhouse LLC shall issue a credit to your credit card account in the amount of the incorrect price.


Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by The Vintage Playhouse LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of New York, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of The Vintage Playhouse LLC products) shall be in the state or federal courts located in Westchester County, New York. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of The Vintage Playhouse LLC products) must be commenced within one (1) year after the claim or cause of action arises. The Vintage Playhouse LLC's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden.
